Indiana’s comparative negligence law is a modified version called the 51% rule. Under this law, anyone can share responsibility in an accident up to 50 percent and still be eligible for compensation. This means that if you were found to be 30 percent at fault in a claim that would have awarded you $100,000, your award would be reduced by 30 percent and you would only recover $70,000. Likewise, you would not be able to recover any damages at all if you were found to be 51 percent or more at fault.
